Terms of Service

These Terms of Service ("Terms") govern your access to and use of Sensed. Please read them carefully. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use Sensed.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Sensed, Skrænten 7, 5270 Odense N, Denmark (CVR: DK 37093378) ("Sensed," "we," "us," or "our"). They apply to your use of the Sensed website, mobile applications, and all related services (the "Service").

By accessing or using the Service, you confirm that you are at least 13 years old (or 16 in the European Union), that you have read and understood these Terms, and that you agree to be bound by them.

2. Changes to Terms

We may revise these Terms at any time. When we make material changes, we will notify you via email or an in-app notice at least 14 days before the changes take effect. Minor changes (e.g. clarifications, corrections) take effect immediately upon posting.

Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. If you disagree with any change, you may terminate your account before the effective date.

3. Your Account

3.1 Registration

To access most features of the Service, you must create an account. You agree to provide accurate, current, and complete information and to keep it updated.

3.2 Account security

You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately at security@sensed.app if you suspect unauthorised access.

3.3 One account per person

Each account is for a single individual. You may not share your account or create accounts on behalf of others without their knowledge and consent.

4. The Service

4.1 What Sensed does

Sensed provides a private space for users to log, explore, and share inner experiences — including synchronicities, dreams, felt presences, and intuitive knowing — and to discover patterns and resonances across the community.

4.2 Not a medical or mental health service

Sensed is not a medical device, clinical tool, therapy service, or crisis resource. Nothing on the Service constitutes professional psychological, psychiatric, or medical advice. If you are in crisis, please contact an emergency service or a licensed mental health professional in your area.

4.3 Service availability

We aim for high availability but do not guarantee uninterrupted access. We may perform maintenance, updates, or suspend the Service for operational reasons. We will notify you of planned downtime where reasonably possible.

5. Your Content

5.1 Ownership

You retain all ownership rights in the content you submit to the Service ("Your Content"), including Signals, text, images, and audio.

5.2 Licence to Sensed

By submitting content, you grant Sensed a worldwide, non-exclusive, royalty-free licence to use, store, display, and process Your Content solely to operate and improve the Service, consistent with your privacy settings and our Privacy Policy. This licence ends when you delete the content or your account, subject to the data retention periods described in the Privacy Policy.

5.3 Aggregate and anonymised data

We may use anonymised, aggregated insights derived from Your Content (e.g. category distributions, temporal patterns) to improve the Service and publish research. This data cannot be linked back to you individually.

5.4 Your responsibility

You are solely responsible for Your Content. By submitting content, you represent and warrant that you have all necessary rights to do so and that Your Content does not violate any law or these Terms.

6. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Submit content that is defamatory, obscene, hateful, or harassing toward any individual or group
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Upload or transmit viruses, malware, or any other harmful code
  • Scrape, crawl, or use automated means to access the Service without our written permission
  • Attempt to reverse engineer, decompile, or access the source code of the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Collect or harvest any personal data of other users without their explicit consent
  • Use the Service for commercial solicitation or spam

We reserve the right to remove any content and suspend or terminate any account that violates these rules, without prior notice.

7. Intellectual Property

7.1 Sensed IP

All rights in the Service — including the software, design, branding, trademarks, and original content created by Sensed — are owned by Sensed or its licensors. These Terms do not transfer any Sensed intellectual property to you.

7.2 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant Sensed a perpetual, irrevocable, royalty-free licence to use that feedback for any purpose without compensation or attribution to you.

8. Third-Party Services

The Service may contain links to or integrate with third-party websites and services. These are provided for convenience only. Sensed does not endorse or control third-party services and is not responsible for their content, privacy practices, or terms. Your use of third-party services is governed by their own terms.

9. Subscriptions and Payments

Certain features of the Service may require a paid subscription. Where applicable:

  • Subscription fees are billed in advance on a recurring basis (monthly or annually) and are non-refundable except as required by law or as expressly stated at the time of purchase.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until that date.
  • We may change subscription pricing with at least 30 days' notice. Continued use after a price change constitutes acceptance of the new price.
  • Payments are processed by third-party payment processors. Sensed does not store full payment card details.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any content on the Service.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SENSED AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL SENSED'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SENSED IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED US DOLLARS (USD $100).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so the above limitations may not apply to you in full.

12. Indemnification

You agree to indemnify, defend, and hold harmless Sensed and its affiliates, officers, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to your use of the Service, Your Content, or your violation of these Terms.

13. Termination

13.1 By you

You may close your account at any time via the account settings page or by contacting us at support@sensed.app. Upon closure, your data will be handled as described in the Privacy Policy.

13.2 By Sensed

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law, or for operational reasons. We will notify you of termination unless doing so would compromise a security investigation or is prohibited by law.

13.3 Effect of termination

Upon termination, your right to use the Service ceases immediately. Sections 5, 7, 9, 10, 11, 12, 14, and 15 of these Terms survive termination.

14. Governing Law and Disputes

These Terms are governed by the laws of Denmark, without regard to its conflict of law provisions.

Before filing any formal dispute, you agree to first contact us at legal@sensed.app and attempt to resolve the issue informally for at least 30 days.

Any dispute that cannot be resolved informally shall be submitted to binding arbitration in Denmark under the rules of the International Centre for Dispute Resolution (ICDR), except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights or confidential information.

If you are a consumer resident in the EU, you may also have the right to bring a claim before the courts of your country of residence.

15. General

  • Entire agreement: These Terms and our Privacy Policy constitute the entire agreement between you and Sensed regarding the Service.
  • Severability: If any provision of these Terms is found unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force.
  • No waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
  • Assignment: You may not assign your rights or obligations under these Terms without our written consent. Sensed may assign its rights and obligations without restriction.
  • Force majeure: Sensed is not liable for delays or failures in performance caused by events beyond our reasonable control.
